Q. As a foreigner, am I allowed to own this villa legally?
A. Yes. The development land is freehold, owned by the villa owners collectively.
The owners then issue successive 30 year leases to themselves.
An individual villa owner's legal package will consist of the following:
1. An equal ownership share of the land in its entirety.
2. An individual lease agreement for their particular villa and land.
3. A service agreement pertaining to the day to day operation of the community.
Q. How will my property be looked after in my presence and my absence?
A. the Villas overlooking layan is a 'gated' community with 24 hr security.
Property management of the community will be ultimately governed by the villa owners collectively, through an elected Mana gem ent Committee.
A manager and support staff support will be employed.
Some owners may choose to have 'live in' staff for their individual residences.
However, a wide variety of services including daily maid service will be available.
Q. What is the Management Fee?
A. Ultimately the management fees will be determined by the owners themselves.
But the monthly maintenance/management fee is expected to average THB 12-15,000/mo.
This includes management, security, general landscaping and maintenance.
Q . How are utilities charged?
A. All utilities including catv and telephone will be owned by the owners collectively.
These utilities will then be 'sold' back to the owners and billed according to usage.
There will be a small surcharge on the cost of utilities to cover administrative charges.
Surplus funds for such services will be credited to the community's 'sinking fund'.
Q. How do I pay for my Villa?
A. 1. A refundable reservation fee of THB150,000 is required to reserve the property and have your legal representation go over the legal documents.
2. Should you decide to proceed, there is a 10% deposit required upon signing all procurement agreements for legal registration and documentation.
3. All remaining payments will coincide with the construction progress of your villa.
Q. What about Interiors?
A. • Layan Interiors , a design team dedicated to the interior finishing of the Villas overlooking layan , and an affiliate of the developer, has been appointed to coordinate all final finishing works to the exact standards of the villa owners.
